Manifestation Determination
Manifestation Determination is a section of due process included in the Individuals with Disabilities Education Act (IDEA) used when it is necessary to determine whether a student's behavior, that goes against the student code of conduct, is because of the student's disability, or because of a failure to implement the student Individual Education Programs (IEP). These violations, which require Manifestation Determination, are those which would require a change in placement for the student (as defined by IDEA 2004). In other words, this is due process to establish if a students behavior problem was or was not a manifestation of a students disability and to try to find a connection between the poor behavior and the disability. This process is completed during the IEP meeting. This takes place within 10 school days of the determination where a students placement will be changed due to behavioral misconduct. The group chosen to discuss this matter typically includes: Special Education support staff, administration, school social workers, teachers, paraprofessionals, and counselors.
